Welcome to Asmus Toys. By accessing our website and completing a purchase, you agree to the following legally binding terms and conditions. These terms govern the relationship between Asmus Toys ("we," "us," "our") and the customer ("you"), and supplement our dedicated Shipping and Refund policies.

1. The Purchase Agreement

  • Binding Sale: A contract is formed only when Asmus Toys accepts your order and processes your payment. We reserve the right to cancel orders due to pricing errors, stock discrepancies, or delivery restrictions.

  • Accuracy of Information: You are responsible for providing current, complete, and accurate purchase and account information. Asmus Toys is not liable for delivery failures caused by inaccurate information provided at checkout or via third-party payment processors (e.g., PayPal).

2. Intellectual Property

  • Ownership of Content: All content on this site—including but not limited to text, graphics, logos, button icons, digital prototypes, 3D renders, and photography—is the exclusive property of Asmus Toys or its licensors and is protected by international copyright and trademark laws.

  • Prohibited Use: You may not reproduce, duplicate, copy, sell, or exploit any portion of our products, designs, or website content for commercial purposes without express written permission from us. Unauthorized use of our intellectual property may result in legal action.

3. Hand-Crafted Artistry & Prototype Variations

Our products are high-end collectibles that often involve hand-painted and hand-tailored components.

  • Artistic Variation: Minor variations in paint application, weathering effects, hair styling, or fabric drape are inherent to the production process and are not considered defects.

  • Prototype Disclosure: While we strive for accuracy, the final mass-produced product may have slight variations in paint, fabric, or articulation. These are standard parts of the manufacturing process and are not considered defects. A 5–10% variance in color or detail is considered within acceptable industry tolerances and does not constitute "Not as Described."

4. Payment & Subsidized Shipping

  • Price Composition: The total amount paid at checkout includes the Product Price + Shipping Fees.

  • Asmus Shipping Subsidy: To maintain competitive global rates, Asmus Toys partially subsidizes (covers) the actual cost of international freight. The shipping fee paid by the customer is a discounted rate and does not represent the full logistics expense incurred by us to dispatch your order.

  • Tax Exclusions: Our prices do not include Import VAT, GST, Customs Duties, or Courier Brokerage Fees. These are independent charges levied by your local government.

5. International Customs (DDU) & Refusal Policy

  • Importer of Record: As the recipient, you are the "Importer of Record" and must comply with all local laws. All orders are shipped Delivered Duty Unpaid (DDU).

  • Refusal of Duties: Payment of import fees is a requirement of the purchase contract. If you refuse to pay customs fees and the package is returned or abandoned:

    1. The shipping fee paid at checkout is non-refundable.

    2. The un-subsidized portion of the shipping cost (the part Asmus originally covered for you) will be deducted from any available refund.

    3. Any return freight charges or abandonment fees issued by the carrier will be the customer's responsibility and deducted from the refund.

6. Pre-Orders

Release dates are estimates. Failure to pay the final balance by the notified deadline results in the forfeiture of your pre-order slot and deposit, as governed by our Refund Policy.

7. Chargebacks & Disputes

  • Resolution First: You agree to contact Asmus Toys support to resolve any issues before initiating a chargeback or dispute with your bank.

  • Evidence of Agreement: In the event of a chargeback filed to bypass our non-refundable deposit or customs refusal policies, these Terms of Service will be submitted to the financial institution as evidence of the contractual agreement.

8. Limitation of Liability

Asmus Toys is not liable for delays caused by customs clearance, local postal services, or external global events. Our liability ends once the carrier confirms the package as "Delivered" to the address provided during the checkout process.


Asmus Toys reserves the right to modify, update, or change any part of these Terms of Service, product pricing, or site content at any time without prior notice.

We reserve the right to refuse service or cancel orders to anyone for any reason at any time.

These terms shall be governed by and construed in accordance with the laws of our operating jurisdiction.
